{"id":1908,"date":"2022-08-02T08:49:46","date_gmt":"2022-08-02T07:49:46","guid":{"rendered":"https:\/\/www.calligo.io\/update-8-the-data-privacy-periodic-table-aug-2022\/"},"modified":"2023-10-03T14:22:40","modified_gmt":"2023-10-03T13:22:40","slug":"update-8-the-data-privacy-periodic-table-aug-2022","status":"publish","type":"post","link":"https:\/\/www.calligo.io\/insights\/data-privacy\/update-8-the-data-privacy-periodic-table-aug-2022\/","title":{"rendered":"UPDATE 8: The Data Privacy Periodic Table"},"content":{"rendered":"\n<p><strong><em>By Sophie Chase-Borthwick, Calligo\u2019s Global Data &amp; Governance Lead<\/em><\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>From the increasing importance of ethical AI principles, to the <a href=\"https:\/\/www.calligo.io\/insights\/blog\/update-7-the-data-privacy-periodic-table\/\">EU\u2019s all-encompassing data strategy<\/a> \u2013 including the first law on AI by a major regulator, anywhere &#8211; and US President Joe Biden\u2019s <a href=\"https:\/\/iapp.org\/news\/a\/eu-us-agree-in-principle-to-new-transatlantic-data-agreement\/\">new transatlantic data agreement<\/a>, much has been bubbling away in the world since <a href=\"https:\/\/www.calligo.io\/insights\/blog\/update-7-the-data-privacy-periodic-table\/\">my previous revision<\/a> of The Data Privacy Periodic Table.\u00a0<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Here I delve into the whys and wherefores of any changes I\u2019ve made since then \u2013 in the form of Update 8.<\/p>\n\n\n\n<p><br><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-203-1024x625.png\" alt=\"\" class=\"wp-image-5049\"\/><\/figure>\n\n\n\n<p><a style=\"color: #000000\" href=\"https:\/\/www.calligo.io\/insights\/blog\/the-data-privacy-periodic-table\/\" class=\"btn btn--hollow btn--orange\">Download PDF version<\/a>\n<p><strong>Fundamental Principles of Data Protection \u2013 some newcomers\u2026<\/strong><\/p><\/p>\n\n\n\n<p><strong>Acting FAST on ethical AI<\/strong><\/p>\n\n\n\n<p>6-9<\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-131-1024x264.png\" alt=\"\" class=\"wp-image-4894\" width=\"398\" height=\"103\"\/><\/figure>\n\n\n\n<p>The Alan Turing Institute developed the \u2018FAST Track Principles\u2019 to support a responsible environment for data innovation, in particular when understanding Artificial Intelligence ethics and safety. To reflect the importance of \u2018ethical AI\u2019 (as demonstrated by the ICO\u2019s collaboration with the Institute) I have added <strong>Accountability<\/strong> and <strong>Sustainability<\/strong> for the first time.<\/p>\n\n\n\n<p>While Sustainability<strong> <\/strong>is the only element that\u2019s really unique to AI, <strong>Fairness<\/strong> and <strong>Transparency<\/strong> (moved, but not new) have and always will be fundamental to data privacy. I had considered Accountability to be almost too obvious and intrinsic a component of privacy to have its own place. But, as a nod to my opinion that the FAST Track Principles should become industry standards, here it is. After all, FST certainly doesn\u2019t have the same ring to it.<\/p>\n\n\n\n<p>While I can\u2019t go into huge detail here about each one, I urge anyone who hasn\u2019t read up on<a href=\"https:\/\/www.gov.uk\/guidance\/understanding-artificial-intelligence-ethics-and-safety\"> FAST<\/a> to do so now \u2013 and embed the principles into every aspect of AI project delivery.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cAs inert and program-based machinery, AI systems are not morally accountable agents. This has created an ethical breach in the sphere of the applied science of AI that the growing number of frameworks for AI ethics are currently trying to fill. Targeted principles such as fairness, accountability, sustainability, and transparency are meant to \u2018fill the gap\u2019 between the new \u2018smart agency\u2019 of machines and their fundamental lack of moral responsibility.\u201d<\/em><\/p>\n<cite><strong>The Alan Turing Institute: Understanding Artificial Intelligence Ethics and Safety<\/strong><\/cite><\/blockquote>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Source: <\/strong><a href=\"https:\/\/www.turing.ac.uk\/sites\/default\/files\/2019-08\/understanding_artificial_intelligence_ethics_and_safety.pdf\"><strong>https:\/\/www.turing.ac.uk\/sites\/default\/files\/2019-08\/understanding_artificial_intelligence_ethics_and_safety.pdf<\/strong><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Moved, but not downgraded<\/strong><\/h2>\n\n\n\n<p><strong>34 &amp; 35<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-132.png\" alt=\"\" class=\"wp-image-4895\" width=\"201\" height=\"103\"\/><\/figure>\n\n\n\n<p><strong>Lawfulness<\/strong> and <strong>Necessity<\/strong> have made way for FAST. Far from downgraded, they\u2019ve merely moved a little within the same elemental area. But, <strong>Relevancy<\/strong> has been removed altogether. In my opinion, this is more than covered by Necessity and there\u2019s no need to double up on similar principles.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Retention becomes the industry norm\u2026<\/strong><\/h2>\n\n\n\n<p><strong>5<\/strong>3<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-133.png\" alt=\"\" class=\"wp-image-4896\" width=\"96\" height=\"96\"\/><\/figure>\n\n\n\n<p>We welcome<strong> Retention <\/strong>to the table<strong> \u2013<\/strong> this echoes the fact that this has become more of an industry standard term.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Highly unstable, yet fascinating Future Developments\u2026<\/strong><\/h2>\n\n\n\n<p>And now for the fast-moving, highly unstable elements: the future developments that are shaping the world\u2019s data privacy parameters and legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>US legislation limbo\u2026<\/strong><\/h2>\n\n\n\n<p><strong>112<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-134.png\" alt=\"\" class=\"wp-image-4897\" width=\"100\" height=\"100\"\/><\/figure>\n\n\n\n<p>To the United States and various <strong>US Bills<\/strong> \u2013 starting with President Joe Biden\u2019s <a href=\"https:\/\/iapp.org\/news\/a\/eu-us-agree-in-principle-to-new-transatlantic-data-agreement\/\">new transatlantic data agreement<\/a> in principle with the European Union.&nbsp;<\/p>\n\n\n\n<p>We\u2019ve been here twice before \u2013 with similar proposals previously thrown out. Although it doesn\u2019t seem to be going anywhere fast, this is hugely important, due to the rocky recent history of EU-US data flows \u2013 following the invalidity of the Safe Harbor and subsequent Privacy Shield framework.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Above all, greater certainty is needed for the vast amount of companies that regularly exchange data between Europe and the US.<\/p>\n\n\n\n<p>Then there\u2019s the ADPPA &#8211; the American Data Privacy and Protection Act &#8211; a bill designed to regulate how organizations collect, process, manage, and even securely store personal information or \u201ccovered data.\u201d The US does not yet have a comprehensive privacy law that creating such safeguards. The ADPPA has bipartisan support, but also faces opposition from privacy advocates and business groups.<\/p>\n\n\n\n<p>After an initial flurry of excitement, how and when these laws will pass is up in the air. In the meantime, individual states are focusing on their own data laws.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>&#8220;We have agreed to unprecedented protections for data privacy and security for our citizens. This new arrangement will enhance the Privacy Shield framework, promote growth and innovation in Europe and in the United States and help companies, both small and large, compete in the digital economy.&#8221;&nbsp;<\/em><\/p>\n<cite><strong>Joe Biden, US President, March 25, 2022<\/strong><\/cite><\/blockquote>\n\n\n\n<p><\/p>\n\n\n\n<figure class=\"wp-block-embed\"><div class=\"wp-block-embed__wrapper\">\nhttps:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/03\/25\/remarks-by-president-biden-and-european-commission-president-ursula-von-der-leyen-in-joint-press-statement\/\n<\/div><\/figure>\n\n\n\n<p><strong>Source: <\/strong><a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/03\/25\/remarks-by-president-biden-and-european-commission-president-ursula-von-der-leyen-in-joint-press-statement\/\"><strong>https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/03\/25\/remarks-by-president-biden-and-european-commission-president-ursula-von-der-leyen-in-joint-press-statement\/<\/strong><\/a><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Retroactively enforceable California Privacy Rights Act<\/strong><\/h2>\n\n\n\n<p>Staying with US Bills, but moving specifically to California state now, and the <a href=\"https:\/\/iapp.org\/resources\/topics\/ccpa-and-cpra\/\"><strong>CPRA<\/strong><\/a> comes into law after January 2023, technically speaking. But \u2013 and there\u2019s a big but \u2013 companies need to be compliant retroactively. The second the law goes live, businesses can be fined for any non-compliance issues dating back to January 2022. Forewarned is definitely forearmed in this case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Across the Atlantic\u2026<\/strong><\/h2>\n\n\n\n<p><strong>118<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-135.png\" alt=\"\" class=\"wp-image-4898\" width=\"91\" height=\"91\"\/><\/figure>\n\n\n\n<p>To Europe and the <strong>EU Data Strategy.<\/strong> Its tagline is: \u2018Making the EU a role model for a society empowered by data\u2019. But this is so much more than the EU\u2019s General Data Protection Regulation. It\u2019s about the entire data landscape; a large regulatory umbrella under which the future of Europe\u2019s data protection sits. Having said that, policymakers are far from finished in creating this broader regulation.&nbsp;<\/p>\n\n\n\n<p>The new laws that will be incorporated into this holistic strategy will include, among others: The Data Act &#8211; aiming to create rights and responsibilities on how valuable forms of data are shared; The Data Governance Act &#8211; to create a &#8220;common European data space&#8221; and &#8220;single market for data&#8221; \u2013 boosting innovation while respecting the values of privacy; and the AI Act \u2013 the first law on AI by a major regulator, anywhere.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Importantly, none of these acts should be viewed in isolation. It\u2019s a positive development that the EU is treating data as an asset (like physical infrastructure). Sewing all the various initiatives together in this way &#8211; data protection, governance, AI and also fair markets &#8211; is a savvy, cohesive approach, in my opinion.&nbsp;<\/p>\n\n\n\n<p>However, it\u2019s hard to know how effective this strategy will be when it comes to improving data development, given the EU currently lags behind on AI \/ ML. It remains to be seen if this will level the playing field, or create yet more red tape.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>\u201cPeople, businesses and organisations should be empowered to make better decisions based on insights from non-personal data, which should be available to all.\u201d<\/em><\/p>\n<cite><strong>European Commission&nbsp;<\/strong><\/cite><\/blockquote>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Source: <\/strong><a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/european-data-strategy_en\"><strong><a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/european-data-strategy_en\">https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/european-data-strategy_en<\/a><\/strong><\/a><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>State of flux<\/strong><\/h2>\n\n\n\n<p><strong>113<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-136.png\" alt=\"\" class=\"wp-image-4899\" width=\"100\" height=\"100\"\/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>In <strong>post-Brexit UK<\/strong>, the new UK-GDPR is nearly identical to the EU-GDPR. However, it is UK legislation independent of the EU. The UK has already performed a consultation process to see what data protection in the UK should look like in the future \u2013 and therefore new developments need to be monitored closely as they unfold.<\/p>\n\n\n\n<p><strong>114<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-137.png\" alt=\"\" class=\"wp-image-4900\" width=\"94\" height=\"94\"\/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>First it was Apple\u2019s move to block third-party <strong>cookies<\/strong> that conduct cross-site tracking on Safari, then Google announced they will do the same in 2023. But, with these changes making things difficult for advertisers and small publishers, what will adtech look like in the future?<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Ever-changing laws\u2026<\/strong><\/h2>\n\n\n\n<p><strong>109<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-139.png\" alt=\"\" class=\"wp-image-4903\" width=\"94\" height=\"94\"\/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Having passed its latest draft of the Personal Data Protection Bill over to the parliament in November 2021, the bill, now referred to as the <strong>Data Protection Bill or DPB<\/strong> as it now contains several provisions on non-personal data, has been pulled from consideration for parliament to draft entirely fresh language.<\/p>\n\n\n\n<p><strong>111<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.calligo.io\/wp-content\/uploads\/2023\/04\/MicrosoftTeams-image-138-1.png\" alt=\"\" class=\"wp-image-4902\" width=\"91\" height=\"91\"\/><\/figure>\n\n\n\n<p>The <strong>Personal Data Protection Law (PDPL)<\/strong> is the first of its kind to be passed in Saudi Arabia. The protection rules were first published in September 2021 and they are due to come into effect in March 2023.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><em>The Data Privacy Periodic Table is entirely unique to Calligo and is an ongoing project, contributed to by the entire industry.
